Guest Terms and Conditions

This Rental Agreement ("Agreement") is a legally binding contract between the Guest ("You" or "Your") and the Property Owner or Management Company ("Company," "We," or "Us"). By booking the Property, You acknowledge that You have read, understood, and agreed to the terms, conditions, and policies outlined below.

General Policies
1. Quiet Hours: Guests and occupants must observe quiet hours from 10:00 PM to 9:00 AM daily. Excessive noise that disturbs neighbors may result in fines or termination of the rental without refund.
2. No Smoking: Smoking of any substance (including but not limited to tobacco and marijuana) is strictly prohibited inside the Property or on its premises. Violations are subject to a $300 cleaning fee.
3. No Parties: The Property may not be used for parties, events, or gatherings without express written approval from the Company. Unauthorized events may result in immediate termination of the rental without refund.
4. No RV Parking: Recreational vehicles, trailers, and similar large vehicles are not permitted to park at the Property unless otherwise approved in writing.
5. No Unregistered Guests: Only registered guests listed in the reservation are permitted on the Property. Unauthorized guests are subject to an additional charge of $75 per person per night.
6. Minimum Age: You must be at least 25 years old to book and rent the Property. Proof of age may be required.

Fees and Additional Charges
1. Unauthorized Guests: $75 per guest per night.
2. Smoking Fee: $300 for smoking inside the Property.
3. Unapproved Pet Fee: $250 for unauthorized pets.
4. Noise Complaints:
- First complaint: Warning issued.
- Second complaint: $250 fine and termination of stay without refund.
5. Late Checkout: $25 for every 15 minutes past the designated checkout time without prior approval.
6. Improper Waste Disposal: A minimum $100 service fee, plus the cost of repairs, for flushing non-flushable items (e.g., baby wipes) that result in plumbing issues.

Acknowledgment of Property Rules
The specific details of the Property, including parking restrictions and maximum occupancy limits (as stated in the listing or Property Description), are incorporated into this Agreement by reference and are binding upon You.

Reservation and Payment Terms
1. Payment Schedule: For reservations made more than 30 days prior to check-in, a deposit equal to one night's lodging plus booking fees is required at booking. The remaining balance, including lodging, taxes, fees, and security deposit (if applicable), will be charged 15 days prior to Your arrival. Reservations made within 30 days of arrival will require full payment at the time of booking.
2. Payment Methods: Payments are accepted via credit or debit card. Checks or cash are not accepted.
3. Third-Party Bookings: If booking through a third-party platform, additional fees and policies may apply. Please review all third-party terms before confirming Your booking.

Occupancy and Use
1. Responsible Renter: You must occupy the Property during the entire rental period. You are responsible for the actions of all occupants, including family, friends, and invitees.
2. Maximum Occupancy: The number of guests, including children, may not exceed the maximum occupancy stated in the Property Description.
3. No Commercial Use: The Property may not be used for commercial activities, including events, photoshoots, or film production, without prior written consent.

Guest Responsibilities
1. Care of Property: You agree to treat the Property with care and leave it in the condition it was in upon arrival. Damages caused by negligence or misuse will be charged to You.
2. Security: Ensure all windows and doors are locked when not on the premises.
3. Housekeeping: Basic cleaning is required upon checkout, including rinsing dishes and leaving the Property in reasonable order.
4. Prohibited Activities: Criminal activity, illegal downloads using the Property's internet, or actions violating local laws are strictly prohibited.

Consequences of Breach*
Violation of this Agreement may result in:
1. Immediate eviction without refund.
2. Forfeiture of any security deposit.

Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, or consequential damages, including personal injury, loss of property, or inconvenience, arising from Your use of the Property.

Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from Your actions or omissions, or those of Your occupants, during the rental period.

Binding Arbitration
All disputes arising under this Agreement shall be resolved through binding arbitration. By agreeing to these terms, You waive Your right to a trial by jury and to participate in any class-action lawsuit.
